1. Introduction & Acceptance
Welcome to PumpThePump ("Platform", "we", "us", or "our"). By accessing or using the PumpThePump website, smart contracts, decentralized exchange (DEX), and any associated services (collectively, the "Services"), you ("User", "you") agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, you may not use the Services. These Terms form a legally binding agreement between you and PumpThePump.
2. Eligibility & Compliance Requirements
2.1 Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet this requirement.
2.2 Compliance for Degen Prize Claims
Degen reward claims follow the live tier compliance policy configured by the protocol. For tiers where payout verification is enabled, the winner must verify an approved CEX payout destination, pass sanctions and proof checks, and complete the burn-and-payout flow before funds are released. Influencer rewards do not use this same degen payout-verification path.
2.3 Prohibited Jurisdictions
Users from jurisdictions where the use of the Services or participation in such token promotion activities is prohibited by law are not permitted to use the Services. You are solely responsible for determining whether your use of the Services complies with applicable laws in your jurisdiction.
3. Platform Description – A Token Promotion Ecosystem
PumpThePump is a gamified token promotion platform built on the Solana blockchain. It allows:
- Creators of existing tokens to deposit a "Creators Fee" to nominate their token for promotion.
- Degens to trade tokens via the Platform's DEX and, by meeting a minimum buy requirement, become eligible for a random reward (the "Degen Reward").
- Influencers to refer users to the Platform's DEX and, based on the number of unique referrals that trade, become eligible for a reward (the "Influencer Reward").
The Platform does not operate a gambling service. All rewards are funded solely by the Creators Fees paid by token creators who voluntarily seek promotion of their tokens. The selection of reward recipients is determined by the protocol's random draw and settlement process. No user pays to enter a lottery; rather, users perform a bona fide trading activity (buying or selling tokens) and, as a promotional incentive, may receive a reward if certain volume and referral conditions are met.
4. User Responsibilities & Prohibited Activities
4.1 User Responsibilities
- You are responsible for securing your own wallet and private keys. The Platform never takes custody of your funds.
- You are responsible for understanding the mechanics of the Platform, including the fees, volume targets, and reward distribution.
- You are solely responsible for any taxes, reporting, or other legal obligations arising from your use of the Services.
4.2 Prohibited Activities
You agree not to:
- Use the Services for any illegal purpose or in violation of any applicable law or regulation.
- Engage in market manipulation, wash trading, or any activity that artificially inflates volume or referral counts.
- Use the Services to promote tokens that are securities, scams, or otherwise violate applicable laws.
- Attempt to interfere with the proper functioning of the Platform's smart contracts or backend systems.
5. Fees & Rewards
5.1 Fees
The Platform charges fees as follows:
- Creators Fee: A percentage (as displayed on the Platform) deducted from creator deposits at the time of deposit.
- Trading Fee: A 1% fee on both buy and sell transactions executed through the Platform's DEX.
- Redemption Fee: A 2.5% fee deducted from degen NFT prize redemptions and influencer reward claims before the net payout is released.
All fees are transparently displayed on the Platform before any transaction.
5.2 Rewards
- Degen Reward: A randomly selected eligible trader receives an NFT prize. The value of the NFT prize is determined by the Tier of the batch and is funded by Creators Fees.
- Influencer Reward: Top-performing influencers receive guaranteed compensation for verified referral performance, according to the active tier policy.
Rewards are distributed only after the token has reached the required volume target. Volume targets are set by the Platform and displayed on the Platform.
6. Risk Disclosures
6.1 Smart Contract Risk
The Platform is governed by smart contracts deployed on the Solana blockchain. While the contracts have been audited, no smart contract is immune to bugs or exploits. You acknowledge and accept that your use of the Services may result in total loss of funds.
6.2 Market Risk
Trading tokens involves substantial risk. The Platform does not provide financial advice, and you should never trade with funds you cannot afford to lose.
6.3 Regulatory Risk
The regulatory landscape for cryptocurrencies, DeFi, and token promotion is uncertain. The Platform does not guarantee that any aspect of the Services is or will remain compliant with the laws of your jurisdiction. You bear all risk of regulatory changes.
6.4 Technical Risk
The Platform relies on third-party services (e.g., PumpSwap, Helius, RPC/indexing providers, and compliance APIs). Interruptions or failures of those services may affect the Platform's availability or correct operation.
7. Intellectual Property
All content on the PumpThePump website and related materials (excluding third-party trademarks) is owned by the Platform and protected by intellectual property laws. You may not copy, modify, or distribute any of our content without prior written permission.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PUMPTHEPUMP, ITS FOUNDERS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO THE PLATFORM IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify and hold harmless PumpThePump, its founders, contributors, and affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party rights.
10. Dispute Resolution & Governing Law
10.1 Governing Law
These Terms shall be governed by the laws of the British Virgin Islands, without regard to its conflict of laws principles.
10.2 Arbitration
Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the London Court of International Arbitration (LCIA) in accordance with its rules, and judgment upon the award may be entered in any court having jurisdiction. The arbitration shall be conducted in English, and the seat of arbitration shall be London, United Kingdom.
10.3 Class Action Waiver
You agree to resolve any disputes on an individual basis and waive any right to participate in a class, collective, or representative action.
11. Modifications & Termination
We reserve the right to modify these Terms at any time. Notice of material changes will be posted on the Platform. Your continued use of the Services after such notice constitutes acceptance of the modified Terms.
We may terminate or suspend your access to the Services at any time, without notice, for any reason, including if you violate these Terms.
12. Miscellaneous
- Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force.
- Entire Agreement: These Terms constitute the entire agreement between you and the Platform regarding the Services.
- No Waiver: Our failure to enforce any right or provision shall not be deemed a waiver of such right or provision.
By using PumpThePump, you acknowledge that you have read, understood, and agree to be bound by these Terms.
